As mentioned in our November 2024 employment update, the Bill will make employers liable for third party harassment unless the employer took all reasonable steps to prevent it. This will cover all harassment, not just sexual harassment.
Steps an employer can take to prevent third party harassment, include:
- Clear anti-harassment policies.
- Training for employees and managers.
- Adopting a zero-tolerance approach to harassment.
- Effective reporting mechanisms.
- Monitor high-risk situations.
- Contractual clauses with third parties.
- Adopting and promoting a supportive environment.
- Swift investigation and responses; and
- Regular reviews and risk assessments.
With employer liability for third-party harassment set to increase, now is the time to review your policies and procedures. If you need guidance on implementing preventative measures or ensuring compliance, contact our Employment team today.
